Understanding TDIU: Who Qualifies and How to Apply

← Back to Blog

Overview

Total Disability based on Individual Unemployability — TDIU — is one of the most valuable and most misunderstood benefits in the VA system. It allows certain veterans to be paid at the full 100% compensation rate, even if their combined schedular rating is lower, as long as their service-connected conditions prevent them from holding steady, substantially gainful employment. This guide walks through who qualifies, the two main paths to get there, and how to build a strong application.

What TDIU Actually Means

Your disability rating measures medical severity, but it doesn't always capture whether you can actually hold a job. TDIU exists to bridge that gap — it recognizes that a veteran rated at, say, 70% combined might still be completely unable to sustain full-time work because of how their conditions affect them in a real work environment. When granted, TDIU pays at the 100% rate regardless of your actual combined schedular percentage.

The Two Paths to Qualify

Schedular TDIU is the more straightforward path. You generally qualify if:

Extraschedular TDIU is for veterans who don't meet those percentage thresholds but can still show their service-connected conditions prevent substantially gainful employment. This path requires the VA's Director of Compensation Service to review and approve the case individually — it's a higher bar to clear, but it exists specifically so the percentage rules don't lock out veterans with a genuinely strong case.

What "Substantially Gainful Employment" Means

This is the heart of a TDIU claim, and it trips a lot of veterans up. It doesn't just mean "not currently working" — it means you're unable to secure or maintain employment that provides more than marginal income, given your education, work history, and service-connected conditions. Occasional or sheltered work (a family member's business, for example) generally doesn't count against you the way genuine substantially gainful employment would.
